Last Revised: October, 2024
Please read this Privacy Policy (‘Policy’), as it will help you understand what information we collect, how we use it, and what choices you have regarding your information.
This Policy is to inform you of the policies and procedures regarding the collection, use and disclosure of personal information we receive from users of the discovernortheastnebraska.com website (‘Website’), as controlled by the Discover Northeast Nebraska Council (‘Council’). This policy applies to all visitors or users of the Website. The terms ‘you,’ ‘your,’ or ‘User’ refers to any individual or entity who accesses or uses the Website. The terms ‘we,’ ‘us’, ‘our’ or ‘Council’ refer to the Council, its officers, directors, subsidiaries, affiliates, employees, or other agents.
This Policy applies only to information that you provide to us through the Website. This Policy does not apply to information you provide to any third party service provider; information you provide to a third party service provider shall be controlled by the privacy policies and procedures for that provider.
Overview
The Council, in its sole and absolute discretion, may change or modify this Policy, and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to the Website. No revision or update will apply to a dispute which the Council had actual notice of on the date the Council posts the changes or modifications. The Council will notify you of such changes or modifications by posting them to the Website, and your use of the Website after such changes or modifications have been posted (as indicated by a ‘Last Revised’ date) shall constitute your acceptance of the Policy as last revised. If you do not agree to with the Policy as last revised, do not use (or continue to use) the Website.
Information Collected
Types of Information
When you visit the Website or become a User of the Website, we may ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you (‘Personal Information’). Personal Information includes, but is not limited to, your name, username, phone number, email address, and shipping address. We may also collect information you supply to us regarding your personal preferences and interests. You can choose not to provide us with any or all of the information we specify or request, but then you may not be able to register an account with us (‘Account’) or to take advantage of some or all of our features.
We may use your Personal Information to provide the Website and administer your inquiries. We also collect other information that you provide as part of registration and the administration of your Account (e.g., without limitation, age and individual preferences) (‘Non-Identifying Information’).
When you visit the Website, whether as a registered or non-registered User, our servers automatically record information that your browser sends whenever you visit a website (‘Log Data’). This Log Data may include information such as your Internet Protocol address, the browser type or the webpage you were visiting before you came to our Website, pages of our Website that you visit, the time spent on those pages, information you search for on our Website, access times and dates, and other statistics.
In addition to Log Data, we may also collect information about the device you’re using to access the Website, including what type of device it is, what operating system you’re using, device settings, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you’re using and its settings. Check the policies of your device manufacturer or software provider to learn more about what information your device makes available to us.
Methods of Collection
Like many websites, the Website may use ‘cookies’ to collect information. A cookie is a small data file that we transfer to your computer or mobile device’s hard disk for record-keeping purposes. We may use cookies for two purposes. First, we utilize persistent cookies to save your login information for future logins to the Website. Persistent (or permanent) cookies will not contain Personal Information, but may be used to save personalized Website settings. Second, we may utilize session ID cookies to enable certain features of the Website, to better understand how you interact with the Website and to monitor aggregate usage by Users and web traffic routing on the Website. Unlike persistent cookies, session cookies are only accessible to the specific application(s) using the session ID cookes and are deleted from your computer when you log off from the Website and then close your browser. Third party service providers on the Website may also place or read cookies on your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Website.
Collection Notice
Your information may be transferred to and stored on computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, the Council transfers Personal Information to the United States and processes it there. Your consent to this Policy, followed by your submission of such information, represents your agreement to that transfer.
Information Processed
Uses of Information
Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Website Users (defined below) to attempt to provide you with a better experience, to improve the quality and value of the Website and to analyze and understand how our Website is used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.
We may also use your Personal Information to contact you with Council newsletters, marketing or promotional materials and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, follow the unsubscribe instructions provided in any of the communications or update your ‘preferences’ information.
We may use Log Data to monitor and analyze use of the Website and for the Website’s technical administration, to increase the Website’s functionality and user-friendliness, and to better tailor our Website to our visitors’ needs. For example, some of this information may be collected so that when you visit the Website again, it may recognize you and serve advertisements and other information appropriate to your interests. We also reserve the right to use this information to verify that visitors to the Website meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated regarding other Non-Identifying Information.
Disclosures of Information
Please be advised that all information which is collected by state agencies is likely to be considered a public record which is available for public review under the Nebraska Public Records Statutes unless there is a specific statute which allows that information to be kept confidential. An example of a specific statute which allows certain types of information to be kept confidential may be found at Neb. Rev. Stat. Section 84-712.05.
Data gathered through the Website, or through portals or data interchanges maintained by the Council and submitted to state agencies are government records subject to the same rules of access and disclosure as they would be if submitted in paper form. As stated elsewhere in this notice, the general rule under Nebraska public records law is that all government records are open to public inspection unless expressly exempt from that requirement by law.
We may employ third party companies and individuals to facilitate our Website, to provide the Website on our behalf, to perform Website-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Website’s features) to assist us in analyzing how our Website is used, or to perform other services (e.g. without limitation, sending postal mail and e-mail and providing customer service). These third parties have access to your Personal Information only to perform these tasks on our behalf.
The Council may cooperate with other government and law enforcement officials and private parties to enforce and comply with applicable law. We may disclose any information about you to government or law enforcement officials or private parties as we believe necessary or appropriate to respond to claims and legal process (including, but not limited to, subpoenas), to protect the property and rights of the Council or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.
Information Provided
Security
The Council takes reasonable precautions to keep your personal information secure and has put in place appropriate physical, electronic, and managerial procedures to safeguard the information collected through the Website. Due to the nature of the Internet, however, the Council cannot guarantee the security of any information you disclose online, and you do so at your own risk.
We may make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored ‘personal data’ (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Website in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
Choice and Control
All Users may review, update, correct or delete the Personal Information in their Account by contacting us or by editing such profile via the Website, or other authorized third party account. If you completely delete all such information, then your Account may become deactivated. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for legitimate business purposes.
Links to Other Sites
The Website may contain links to other websites. If you choose to visit an advertiser by ‘clicking on’ a banner ad or other type of advertisement, or click on another third party link, you will be directed to that third party’s website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other sites follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.
Children’s Privacy
As a whole, the Website is not directed to children under the age of 13. We do not knowingly collect personally identifiable information from children under 13. Federal law provides that the Council may not require a child to disclose more information on the Website than is reasonably necessary to participate in an activity as a condition of that participation. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.
